1. Acceptance of Terms

By accessing or using the Bannerific website and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). This Service is owned and operated by Mindphase Inc. If you disagree with any part of the terms, then you may not access the Service.

2. Subscriptions and Payments

• Subscription Plans: Bannerific offers monthly and annual subscription plans that grant access to features such as high-resolution exports. You agree to pay the fees associated with your chosen plan.
• Lifetime Deal (LTD): During specific promotional periods, we may offer a "Lifetime Deal". This is a one-time payment that grants access to specific features for the lifetime of the product. "Lifetime" refers to the lifetime of the Service, not the user.
• Refunds: Subscription payments are generally non-refundable. However, we offer a 30-day money-back guarantee for the Lifetime Deal purchase if you are not satisfied.
• Cancellations: You may cancel your subscription at any time. Your access will continue until the end of the current billing cycle.

3. User Content

Our Service allows you to upload, process, and download images ("User Content"). You retain all rights to your User Content.

By uploading User Content, you represent and warrant that you have the right to use such content and that it does not violate any third-party rights (copyright, trademark, privacy, etc.). Mindphase Inc. accepts no liability for the content you process using our tool.

4. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Mindphase Inc. and its licensors. The "Bannerific" name, logo, and safe zone templates are protected by copyright and trademark laws.

5. Accuracy of Information

While we strive to keep our platform templates (LinkedIn, YouTube, X, etc.) up-to-date, social media platforms frequently change their layouts specifications without notice. Bannerific provides validation tools "AS IS" and does not guarantee that a validated banner will never be cropped or obscured by third-party platform updates.

6. Limitation of Liability

In no event shall Mindphase Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any conduct or content of any third party on the Service;
• Any content obtained from the Service; and
• Unauthorized access, use or alteration of your transmissions or content.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
